Terms of Service

The terms governing your use of Accessora's accessibility widget and platform.

Please read these Terms of Service (“Terms”) carefully before using the Accessora platform and services.

Interpretation and Definitions

Interpretation

Words with initial capital letters have the meanings defined below. These definitions apply whether they appear in singular or plural form.

Definitions

For the purposes of these Terms:

  • Company (referred to as “Accessora”, “we”, “us”, or “our”) refers to Accessora, a company registered in Ireland.

  • Service refers to the Accessora accessibility widget, the Shopify app integration, the Accessora dashboard, and the website at accessora.io, collectively.

  • Subscriber (also “you” or “merchant”) means the individual or business entity that installs and configures the Accessora Shopify app or otherwise subscribes to use the Service.

  • End User means any visitor to a Subscriber’s website who interacts with or is affected by the Accessora widget.

  • Widget means the Accessora accessibility overlay that is embedded on a Subscriber’s website.

  • Platform means the Accessora dashboard, APIs, and backend infrastructure that powers the Service.

  • Subscription means a paid plan that grants access to the Service’s features subject to the terms of the selected plan tier.

Service Description

Accessora provides a web accessibility widget and platform that includes:

  • Accessibility Widget: Up to 18 configurable accessibility features including font size adjustment, contrast modes, color filters, reading aids, text-to-speech, keyboard navigation enhancements, and more.
  • Accessibility Profiles: Pre-configured profiles for ADHD, cognitive disabilities, low vision, and motor impairments.
  • AI Image Captions: Automated generation of alt text for product images using computer vision, subject to plan quotas.
  • Accessibility Audits: Automated WCAG accessibility audits of web pages, providing severity-rated findings and compliance scores.
  • Automated Fixes: Runtime DOM modifications that address common accessibility issues such as missing alt text, unlabeled form fields, empty links, heading hierarchy, clickable elements, and ARIA landmarks.
  • Analytics: Aggregated, anonymous usage data about widget interactions.
  • Multi-language Support: Widget interface available in 26 languages.

Important Compliance Disclaimer

Accessora is an accessibility tool, not a legal compliance guarantee.

While Accessora helps improve the accessibility of your website, installing and using the Service does not guarantee that your website is fully compliant with WCAG 2.1, WCAG 2.2, the Americans with Disabilities Act (ADA), the European Accessibility Act (EAA), or any other accessibility law, regulation, or standard.

You acknowledge and agree that:

  • The Widget provides runtime accessibility enhancements as a DOM overlay. These are not permanent code changes to your website.
  • Automated Fixes address common issues but cannot detect or resolve all accessibility barriers.
  • AI-generated image captions may not be 100% accurate and should be reviewed by the Subscriber.
  • Accessibility audit scores are automated estimates and do not constitute a professional accessibility audit or legal opinion.
  • You, as the Subscriber, remain solely responsible for ensuring your website meets applicable legal accessibility requirements. Accessora recommends consulting with accessibility professionals and conducting manual audits in addition to using the Service.

Subscriptions and Billing

Plan Tiers

Access to the Service is provided through subscription plans with varying feature limits and quotas. Plan details, pricing, and quotas are displayed in the Accessora dashboard and Shopify app listing.

Billing

For Shopify merchants, all billing is managed through the Shopify Billing API. Charges appear on your Shopify invoice. By approving the subscription charge through Shopify, you agree to the recurring billing terms of your selected plan.

Quotas

Certain features, including AI image captions and accessibility audits, are subject to monthly usage quotas based on your plan tier. Quota usage resets at the start of each billing cycle.

Plan Changes

You may upgrade or downgrade your plan at any time through the Accessora dashboard. Changes take effect according to Shopify’s billing cycle.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Misrepresent the Service as a guarantee of legal compliance to your End Users or any third party.
  • Attempt to reverse engineer, decompile, or extract source code from the Widget or Platform.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to process, store, or transmit personally identifiable information of End Users beyond what is described in our Privacy Policy.
  • Resell, sublicense, or redistribute the Service without prior written consent.

Intellectual Property

The Service, including the Widget, Platform, documentation, and all related intellectual property, is and remains the exclusive property of Accessora. Your Subscription grants you a limited, non-exclusive, non-transferable license to use the Service for the duration of your Subscription.

Content you provide (such as website content and product images submitted for captioning) remains your property. You grant Accessora a limited license to process this content solely for the purpose of providing the Service.

Limitation of Liability

To the maximum extent permitted by applicable law, Accessora’s total liability arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you to Accessora in the twelve (12) months preceding the event giving rise to the claim.

In no event shall Accessora be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if Accessora has been advised of the possibility of such damages.

Without limiting the foregoing, Accessora shall not be liable for any claims, damages, or losses arising from:

  • Your reliance on the Service as a sole means of achieving legal accessibility compliance.
  • Inaccuracies in AI-generated image captions.
  • Accessibility issues not detected or resolved by the automated audit and fix features.

”AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory. Accessora expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Accessora does not warrant that:

  • The Service will meet your specific requirements or guarantee compliance with any particular standard or regulation.
  • The Service will be uninterrupted, timely, secure, or error-free.
  • AI-generated content will be accurate or complete.
  • Automated fixes will address all accessibility issues on your website.

Data and Privacy

Our collection and use of data is governed by our Privacy Policy. By using the Service, you agree to the data practices described therein.

Termination

We may suspend or terminate your access to the Service immediately if you breach these Terms. You may cancel your Subscription at any time through the Shopify admin or Accessora dashboard.

Upon termination:

  • Your right to use the Service ceases immediately.
  • The Widget will no longer load on your website.
  • Your data will be handled in accordance with our Privacy Policy, including deletion upon app uninstall.

Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

For EU Users

If you are a consumer in the European Union, you benefit from any mandatory provisions of the law of your country of residence.

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. If changes are material, we will provide at least 30 days’ notice via email or a prominent notice in the Service before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
